3717-1-01(B)(68) State of Ohio Uniform Food Safety Code and definitions

"Major food allergen" means:

(a)

Milk, egg, fish (such as bass, flounder, cod, and including crustacean shellfish such as crab, lobster, or shrimp), tree nuts (such as almonds, pecans, or walnuts), wheat, peanuts, soybeans, and sesame; or

(b)

A food ingredient that contains protein derived from a food, as specified in paragraph (B)(68)(a) of this rule.

(c)

The term does not include:

(i)

Any highly refined oil derived from a food specified in paragraph (B)(68)(a) of this rule and any ingredient derived from such highly refined oil; or

(ii)

Any ingredient that is exempt under the petition or notification process specified in the Food Allergen Labeling and Consumer Protection Act of 2004 (Public Law 108-282).
